Vietnam joins the Apostille Convention - streamlining international document legalization

Officially effective from September 11, 2026 pursuant to Official Letter No. 7751/BNG-LS of the Ministry of Foreign Affairs, Vietnam's accession to the Apostille Convention marks a major breakthrough in administrative reform, completely eliminating traditional consular legalization requirements for public documents issued by contracting states.

The Apostille Convention replaces the cumbersome and time-consuming double-legalization process with direct recognition of a single standardized Apostille stamp, creating maximum convenience for individuals and enterprises utilizing cross-border public documents.

1. Core Shift: From Double Legalization to a Single Apostille Stamp

  • Traditional process (Before September 11, 2026): Required a complex, double-legalization process - documents had to be certified in the country of origin, legalized by its Ministry of Foreign Affairs, and subsequently legalized by the Vietnamese Embassy/Consulate in that country (or the Ministry of Foreign Affairs of Vietnam).
  • New process under the Apostille Convention: Public documents bearing a single valid Apostille stamp issued by the competent authority of the origin state hold direct legal validity in Vietnam without requiring further consular legalization.

2. Scope of application and verification mechanism (e-Apostille)

  • Effective Date: September 11, 2026 for contracting states that raised no formal objections to Vietnam’s accession (total: 125 member states). (Note on Territorial Scope: The applicable treaty relation must be determined based on the place of document issuance, not merely the country's name.)
  • Public documents qualified for exemption: Notarial acts, documents issued by Courts, Public Prosecutors, or Judicial Officers (“huissier de justice”), administrative documents, and official certifications executed on documents signed in a personal capacity. (Note: Apostille only certifies the authenticity of the signature, seal, and the capacity of the signatory—it does not certify the document’s content).
  • Excluded document categories: Documents executed by diplomatic or consular agents; administrative documents directly related to commercial or customs operations.
  • e-Apostille verification mechanism: For contracting states utilizing electronic Apostille systems, receiving authorities in Vietnam can directly verify authenticity via QR codes or the dedicated portal apostille.lanhsuvietnam.gov.vn.

Strategic actions

To streamline the consular legalization procedure under the Apostille Convention, enterprises need to follow these three following steps:

  1. Verify Contracting State Applicability

Before submitting the dossier, enterprises should proactively cross-reference the origin country of documents (e.g., US, Germany, Japan, South Korea, Singapore...) against the active member list without objections to apply the correct Apostille procedure.

  2. Optimize Legal Document Onboarding

Advise foreign partners and investors to obtain Apostille stamps (or e-Apostilles) in their origin jurisdiction to significantly reduce processing timelines for corporate incorporation, M&A, or work permit filings in Vietnam.

  3. Leverage Digital Verification Channels

Use the Ministry of Foreign Affairs portal (apostille.lanhsuvietnam.gov.vn) to proactively authenticate e-Apostille codes before formal administrative filings.

BREAKTHROUGH ADMINISTRATIVE REFORM FOR CROSS-BORDER TRANSACTIONS

Implementing the Apostille framework removes traditional consular bottlenecks, delivering a faster, highly cost-effective, and fully transparent investment runway for global business in Vietnam.
